I had the same argument with my band members. You can definitely hear that the bass is playing an E. The chord is definitely an Em. It's the one bloody shame about getting chords from the internet; mistakes get copied over and over. As a concession to my band, play it as Em7. I'm not sure if TP does it that way, but the seventh adds the "D" note that everybody seems to hear and it sounds kinda nice.

It seems that very first person who added the chords to this song on the internet, has been copied to many sites.
Without checking if these chords were right. I had a conflict with my bandmembers about the first chord of the chorus of this song. They were convinced that it was a D. Like all tabs on the internet.
I can't help hearing a Em on this spot.
Checking a dvd of Tom Petty shows i'm right. What do you think?
Bye,
Rob
