Interesting turn of events for us, in that one venue we play actually stood up to the BMI people

Apparently BMI has a contingent of net surfers , who monitor social media for live music, then send in their muscle with bureaucratic threats

So they found a bar we played, and came down on the top dog , insisting on restitution OR legal fireworks yada yada.....

But it was a private 501C3 club , which legally takes 'public presentation' out of BMI's own doctrine

Not being a pushover to BMI, the prez of said club actually hired legal counsul to throw this back in BMI's face , to which they did not respond

Rather disingenuous of BMI , but lesson learned,  i guess for those of us gigging  VFW's , AL, Eagles, Moose , et all private clubs can continue to do so and ignore them

Well i'm not trying to pick on ya Russ, fact is i'm twice the age of a few band members .

Those gigs that end @ 2-3a.m. humping gear around wear me out ....:(

But by gawd, it sure is fun while we're all up there!....:)

Unfortunately , the end result on my turf is, the death of live music fellas. 

Being a number of localities BMI confronts simply shut down

Venue=0           Cover bands=0        Original artist=0

True, no place to hide we try to keep the arrangements simple I am limited on solo work BUT I have been working with a looper and getting the timing right is critical I found using zero effects is best more to come thanks for watching smile


You're some technically adept for an old guy Russ , i usually gotta find someone under 30 to show me stuff like that....and then find where i hid my glasses....~S~

Richard Berry , writer of Louie Louie sold for $750  (later winning  a $2M lawsuit)

So yes, you may claim it's the'law'  , but it can not achieve, nor can it assume any moral high ground as the 'law'   

Were I to have the grand priviledge to play Paul McCartney, Chuck Berry , Robert Plant's creations in front of them, do you really think they'd have hat in hat?, speed dial their lawyers?

Where i to do the same for some up/coming area artist (yes i've met my share) do you think they're approach would differ?

How  anyone steals by simply presenting the 'works' of said entities is purely the machinations of greedy recording industry elitists , who have so little in common with the real musical world it makes me wonder why they pursue it other than stuffing their own coffers

A club has no right to host performances of a work owned by someone else any more than a publishing company has a right to put someone's work on a record if they don't own it.  That is not only morally correct, it's the law.

BMI distributed $950 million in royalties to artists this year on a little over a billion in revenue.   Most of the money they take in goes back to their member artists.

Add in any shopping mall , televised , or otherwise 'public airwave' accessible media playing say, oldies , and the issue would appear to boarder on moral turpitude Jerome

Further, the $$$ goes to the 'copywrite owners',  which in what i understand is the majority of cases , isn't the original creator at all, instead the record labels as well as music industry CEO's are the one's  sucking up the $$$

Yeah, squealed like a stuck pig , figured it out fairly quick on the studio's debut last night.     

Our singer wants some SM58's , which i found on Amazon , but happy with all else

I can see how a 14x 18' room really makes sound a challenge , can't turn up much

Interesting replies , and much appreciated guys.   

Alton is basically thumbing his nose @ BMI , vs. i'm told it's also a good org to join

If we 'create' , i can understand the copywrite laws granting ownership to the creator. 
Where we to do so, this is easy to do (i've done the postage thing in my past) 
IF i was an aspiring artist , i'd want my work foisted upon the public in any mode of communication possible, imitation being the highest form of flattery i can plainly see the exponential return

What i don't understand is where that dime really goes playing covers ,  what % does the actual creator really get?  Most of what i read from top players isn't all unicorns and buttercups concerning the 'industry'

Is slowly shutting us out of all the venues we used to play.....:(

They just don't want to pay the $1K and up a year , then the bands too

In fact, BMI claims anyone who runs so much as a radio or even TV's publicly owe them

They surf the net, find venues on Fbook, and confront the owners

My Q is, does a band need to register to play cover tunes?  Would this then release bar owners the BMI responsibility?   Has anyone else gone down this road?  Christ on a cracker,i'm just a musician , not a lawyer......~S~

Interesting Phill,    so how would you place the mains?  Would they be in front, or in back of the band?  ~S~

Jerome, i do than you for the  room wiz link, in fact it appears i may quite well spend a lotta time there........and we got all powered stuff, 2 powered mains, 4 powered monitors, board takes 4 mics and has all the effects, could fit on a barstool.....i also have a wireless ear monitor, but haven't quite figured it out yet......so here's the deal, we're 'stage volume' with only volcals going thru the 'PA'  , trying to run as light as possible, no  heavy woofers , i literally bought it all with weight in mind , just haven't run it all 'live' yet so i'm on pins/needles  ~S~

I have zero idea of what green screen is Russ, but it's way cool and would like to learn more   ~S~

Good advice all & thx,  i bought all new cables Zurf, because of that exact reason.....AND i found out the come colored, so there's no need to really label the board anymore

And i gave the last sound man that ran us (along with the noob start up band)  my number , trying to get him to the studio ,pay him a few hours of his time bswyers ,  but i'm thinking a 14 X 18 room isn't a club 'reality'  ......

and what is your opinion on front vs backlighting?   Personally i felt blind as well as deaf w/ frontlighting

Well we have a band,  the new drummer comes in tomorrow (thankfully, because i'm not much good at setting up the Gretch set)  , we've something like 60 odd tunes to go over , and i have to learn how to do 'stage sound' fairly quick , so i got a wireless for my bass, figure i could go for a walk if i can't get someone from the crowd to thumbs up/down.....still intimidating ........sound can make/break a band!     ~S~

The drummer quit, and with it  the rehearsal studio and sound gear went'poof' 

And we've booked gigs ......so i beat feet, built a studio in the barn>
